Terms & Conditions


Vane Contemporary Art Limited is a company registered in England and Wales under number 4313545 whose registered office is at Orbis Community, 65 High Street, Gateshead, NE8 2AP, United Kingdom. 

The following terms and conditions listed below will apply between you and Vane Contemporary Art Limited for the sale and purchase of the items contained in your basket. The terms do not affect your statutory rights (under governing law and Jurisdiction).

Availability of goods and prices
All prices indicated for products are in Pounds Sterling, and are exclusive of delivery charges. The total cost of your order is the price of the products ordered plus delivery charges as set out in the payment section of the Website.

Vane makes every attempt to ensure that all prices on our website are accurate, however discrepancies may occur. If we discover an error in the price of goods already ordered we will inform you as soon as possible and ask that you reconfirm your order at the correct price, whilst also giving you the option to cancel it. If we are unsuccessful in contacting you we will consider the order cancelled.

If we cancel your order, you will receive a full refund.

Vane reserves the right to change prices or to withdraw an item from sale without prior notice.

Goods will be sent to the address given by you in your order and stated in the Order Confirmation. We will use reasonable endeavours to deliver products within 30 days of the date of our order confirmation. However, we cannot guarantee delivery by the relevant date. We do however guarantee that unless there are exceptional circumstances all deliveries of products will be dispatched within 30 days of the later of receipt of payment and the date of our order confirmation.

Acceptance of Orders
All orders are subject to acceptance and product availability. Acceptance of the order and the completion of the contract between yourself and Vane will take place when we have dispatched the goods you have ordered, and received payment. We may choose not to accept your order; if an item is out of stock, if we are unable to obtain authorisation for your payment or if we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time.

Acknowledgment of Order
When you have completed your order you will be sent an e-mail confirmation. It will state what the products are on order, the total cost and Post & Package charges, together with delivery and invoice details. If for any reason your order cannot be processed, the gallery will contact you to explain the nature of the difficulty.

Payment
All credit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and Vane will not be liable for any delay or non-delivery.

With payments by cheque or bank transer, goods will not be dispatched until the funds have cleared into Vane’’s accounts.

Duties and Taxes
If your delivery address is not within the United Kingdom, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. You will be liable for all duties or levies payable at any foreign port as a result of delivery of goods outside of the United Kingdom. It is your responsibility to arrange payment for any such payments and you shall not be entitled to cancel your order on the basis of unforeseen duties or levies. You should note that customs policies vary widely from country to country; Vane advises each customer to contact their local customs office for further information.

You should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

Acceptance of Delivery
While Vane takes every precaution to ensure all deliveries reach you in good condition, we cannot accept responsibility for any damage sustained once a product has arrives at the delivery address. Goods should be inspected upon delivery and any goods that arrive in an obviously damaged condition should not be accepted, this is especially important when goods are being delivered to a business address and not being signed for directly.

Returns
Under the Sale of Goods Act you may cancel a contract to purchase a product or products at any time within 7 working days after the day you received the relevant product or products. 

If you cancel a contract on this basis, you must inform us email, letter or fax and return the products to us immediately, in the same condition in which you received them. Products returned by you in accordance with this Section will be refunded in full (including the cost of sending the products to you). However, you will be responsible for paying the cost of returning the product to us. 

If you cancel a contract on this basis and you do not return to the products to us, we may recover the products and charge you for the costs we incur in doing so. Similarly, if you return the products at our expense, we may pass that expense on to you. 

All work purchased online or from the gallery is sold as seen. Your statutory rights as a consumer are not affected. 

Risk and ownership 
The products will be at your risk from the time of delivery. Ownership of the products will only pass to you upon the later of: 
(a) delivery of the products; and 
(b) receipt by us of full payment of all sums due in respect of the products (including delivery charges). 
We will be entitled to recover payment for the products even where ownership has not passed to you.

Your undertakings and warranties
You warrant that the information given on your order form is complete and accurate. By using the Website, you agree to keep your password and account details confidential, and to take all reasonable measures to prevent unauthorised access to your account. You are responsible for all actions that occur in relation to your account.

Validity
By ordering a product you accept these terms and conditions. The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes.

Limitation of Liability
Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction, however nothing in these terms and conditions shall exclude or limit Vane's liability for death or personal injury as a result of Vane's negligence.

Invalidity of Terms and Conditions
If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.

Data Protection
Vane will take all reasonable precautions to protect your personal data. Vane will never make your personal details available to other companies for marketing purposes. We will keep a record of your address details with the intention of sending your order. See Vane Privacy Policy for more information.

Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with English Law and agree to submit to the exclusive jurisdiction of the English courts.
